Ian Alperstein and Chauncey Dean obtained a defense verdict for Citizens Insurance in Miami Dade County Circuit Court. The plaintiff alleged that Citizens breached its contract by denying a claim for a wind-created opening in the plaintiff’s roof that led to interior water damage in his home. Our defense was that the water damage was not caused by the opening in the roof but rather improper installation and improper construction of the roof as well as wear and tear. After deliberating for less than 30 minutes, the jury found that the plaintiff failed to meet his burden of proof showing that a windstorm event caused an opening in his roof which led to interior water damage.
