Thomas DeGrace, a partner in our Purchase, New York office, secured a decision in New York State Supreme Court, Bronx County granting summary judgment dismissing all claims and crossclaims against our client. MMP&S represented a property owner in a premises liability action where the plaintiff claimed that a piece of wood from a sidewalk bridge scaffold blew off and struck her in the head, neck, back, and shoulders, allegedly causing permanent injuries resulting in several surgeries and a multimillion-dollar demand. Other defendants in the case include the general contractor, the scaffolding contractor, and two subcontractors. Thomas successfully argued that our client had no notice of a defective or dangerous condition, that our client did not have a responsibility to inspect or maintain the sidewalk bridge, and that our client did not cause or contribute to the alleged accident in any way.
