Ian Alperstein and Pamela Agudelo obtained a defense verdict for a first-party property insurance company after a one-week jury trial in the County Court of Broward County, Florida. The plaintiff was a homeowner who alleged that elevated winds and tornados during Hurricane Ian caused damage to her windows and doors. Defendant contended there was no evidence of wind damage to trigger coverage for the claim and that all of the problems were the result of wear and tear and age-related deterioration, which were excluded under the terms of the insurance policy. After deliberating for 12 minutes, the jury found the plaintiff failed to meet her burden of proof that the property sustained wind damage. Thus, the jury found in favor of the property insurance company.
