MMP&S partner James Baden successfully tried a liability-only trial in Kings County, New York. The plaintiff was riding a moped and claimed that our client did not see him and reversed into him while parallel parking. The jury determined the plaintiff was 90% at fault in causing the accident. With the prevalence of erratic moped use throughout New York City, this verdict shows that unsafe riders can be held responsible for causing their own accidents.
