Our Pennsylvania partners Rich Davies and Vittoria Greene, along with former counsel Wendy Bennett, secured a judgment in their favor in the Superior Court of New Jersey Law Division, Essex County, enforcing a Waiver of Consequential Damages provision that resulted in the dismissal of millions of dollars of alleged damages in a case brought against their environmental engineering client arising from the client’s services to provide a remedial action plan for a site being remediated under agreement with the New Jersey Department of Environmental Protection. The ruling produced a nearly 20-page opinion providing clarity on the enforceability of such provisions in New Jersey.
