Ian Alperstein and Isha Kumar obtained a defense verdict for Citizens Insurance in the Palm Beach County Circuit Court. The plaintiff alleged that Citizens breached its insurance contract by denying a claim for water damage caused by a one-time plumbing backup and overflow of water. Our defense was that the water damage was not caused by a one-time plumbing event but rather by long term exposure to water, which was not covered under the Citizens policy. After deliberating for less than an hour, the jury found that the plaintiff failed to meet his burden of proof showing that the property was damaged by water on the alleged date of loss.
