Ian Alperstein and Isha Kumar obtained a defense verdict for a first-party property insurance company after a one-week trial in the County Court of Osceola County, Florida. The plaintiffs were homeowners who alleged that the insurance company wrongfully denied coverage for their insurance claim for wind damage to their mobile home from Hurricane Ian. The insurance company contended that there was no coverage for the insurance claim because there was no evidence of any wind damage and that it was prejudiced by the plaintiffs’ failure to give prompt notice of the insurance claim for their 15-month delay in reporting the insurance claim. After deliberating for 26 minutes, the jury found the plaintiffs failed to meet their burden of proof that the property sustained wind damage from Hurricane Ian. Thus, the jury found in favor of the property insurance company.
