Michael Lynott and Samantha Reynolds of MMP&S obtained a complete defense verdict for a property insurance company in Broward County Circuit Court on March 7, 2024, after a four-day jury trial. The Plaintiff alleged breach of contract for denying a claim for windstorm damage stemming from Hurricane Irma. The defense was that the insurance company was prejudiced by the late notice being that the claim was reported two and a half years later after multiple repairs had been done, with no evidence of the state of the roof after the storm and before the repairs. After deliberating for just over one hour the jury found that the plaintiff failed to meet the burden of proof that the property sustained wind damage from Hurricane Irma on the date of loss, finding in favor of the insurance company.
