Matthew Herlihy

Of Counsel

(914) 681-8709

Matthew grew up in the construction industry, where his father has operated a plumbing contracting company in Westchester County for 40+ years. Observing the pains and struggles a construction company faces in day-to-day operations, especially in the State of New York, Matthew realized that providing legal counsel and assistance to corporate entities within this industry would be where he would have the most impact.

Matthew routinely provides counsel to his corporate clientele on issues related to insurance coverage and policy structuring, liability assessments and determinations, as well as risk management with respect to ongoing or pending claims and litigated matters. He has assisted clients in restructuring their insurance programs, including streamlining programs to provide clients greater autonomy over their litigation, while also helping to shed costly premiums which were otherwise causing financial hardship. Similarly, Matthew has spearheaded the formation of captive insurance programs for clients, providing an alternative to traditional insurance programs.

Matthew is an accomplished litigator, having spent several years at the Bronx County District Attorney’s Office. During that time, he tried numerous cases to verdict, presented more than 100 cases to the Grand Jury, and conducted dozens of suppression hearings. Utilizing his background in criminal prosecutions, investigations, electronic surveillance measures and practice, complex search and seizure issues, and other aspects impacting civil rights related protections, Matthew has litigated and handled numerous matters for persons who have suffered Constitutional violations as the result of false arrest, malicious prosecution, violations of State and Federal civil rights laws, violations of due process laws and regulations, and numerous other forms of civil rights violations. He has represented persons across a wide array of backgrounds and professions, all of whom have suffered from some manner of infringement on their civil and/or Constitutional rights.

Building off this experience, Matthew has been responsible for the defense of clients in a variety of civil matters. During that time, Matthew handled matters for some of the most prominent companies in America, including automotive litigation, labor and construction litigation, commercial and contract litigation, insurance coverage litigation, and high-exposure subrogation matters.

In 2022, Matthew was selected for the Thomson Reuters “Super Lawyers – Rising Stars” for the New York City Metro Region, a distinction awarded to less than 2.5% of all attorneys in New York State. Matthew is licensed to practice law in the State of New York, State of New Jersey, Southern District of New York, and Eastern District of New York.
